Terms of Use
The website located at www.mauralink.com and associated applications (the “Site”) are owned and operated by Mauralink, Inc. (“Company,” “we,” “us,” or “our”), a Delaware corporation. These Terms of Use (“Terms”) govern your access to and use of the Site, including any content, features, and services offered through the Site (collectively, the “Services”).
By creating an account, completing an assessment, or otherwise using the Services, you accept these Terms on behalf of yourself or the entity you represent. You represent and warrant that you have the authority to enter into these Terms. If you do not agree with these Terms, do not access or use the Services.
You must be at least 18 years old to use the Services.
1. Beta Program
1.1 Beta Access
The Services are currently offered as a beta program (“Beta”). Beta access is provided at no cost and may be limited, modified, or discontinued at any time without notice. We may invite or remove participants at our sole discretion.
1.2 Beta Limitations
The Services are under active development. During the Beta period, you acknowledge and agree that:
- (a) Features, scoring algorithms, assessment content, and the user interface may change without notice;
- (b) The Services may contain bugs, errors, or inaccuracies;
- (c) Availability is not guaranteed — we may experience downtime, data loss, or service interruptions;
- (d) Compatibility scores, workstyle profiles, and any other outputs generated by the Services are provided for informational purposes only and should not be the sole basis for any hiring, employment, or personnel decision; and
- (e) We reserve the right to modify, reset, or delete any data — including assessment responses, profiles, and compatibility results — at any time, including upon transition from Beta to general availability.
1.3 Feedback
We welcome and encourage feedback about the Services during the Beta. If you provide suggestions, ideas, bug reports, or other feedback (“Feedback”), you grant Company a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Services without obligation to you. You agree not to submit Feedback that you consider confidential or proprietary.
2. Accounts
2.1 Registration
To use the Services, you must create an account (“Account”) and provide accurate registration information. You agree to keep this information current. You may delete your Account at any time through the Site or by contacting us.
2.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account. You agree to notify us immediately of any unauthorized access to your Account. We are not liable for any loss arising from your failure to protect your Account credentials.
2.3 Invitations
Certain features allow you to invite others to the Services (for example, to complete an assessment for a workstyle comparison). When you invite someone, you represent that you have a legitimate professional or personal reason for the invitation and that the invitee would reasonably expect to receive it. You may not use the invitation feature to send unsolicited or bulk communications.
3. The Services
3.1 What We Provide
The Services include workstyle assessments, individual workstyle profiles, peer comparison reports, and — when available — compatibility scoring for hiring and team contexts. The Services use automated systems to process your assessment responses and generate profiles, scores, and narrative descriptions of workstyle patterns. These outputs are generated programmatically and are not reviewed by a human before delivery.
3.2 Not Employment Advice
The Services provide informational data points about interpersonal work preferences. The Services do not make hiring decisions, provide employment recommendations, or guarantee job performance outcomes. Compatibility scores reflect statistical patterns in workstyle preferences; they do not predict success, measure competence, or assess protected characteristics. Hiring managers and organizations are solely responsible for their own hiring and employment decisions and for compliance with all applicable employment laws.
3.3 License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own internal business or personal purposes. This license does not include the right to:
- (a) License, sell, rent, lease, or commercially redistribute the Services or any content displayed therein;
- (b) Modify, create derivative works from, reverse engineer, or disassemble any part of the Services;
- (c) Access the Services to build a competing product or service;
- (d) Use automated tools (bots, scrapers, crawlers) to access or extract data from the Services, except that operators of public search engines may use spiders solely to create publicly available searchable indices, subject to our robots.txt file; or
- (e) Copy, reproduce, or redistribute any content from the Services except as expressly permitted.
3.4 Modification and Availability
We may modify, suspend, or discontinue the Services (in whole or in part) at any time without notice. We have no obligation to provide support, maintenance, updates, or error corrections.
3.5 Intellectual Property
The Services and all related intellectual property — including software, algorithms, scoring methods, assessment content, visual design, and trademarks — are owned by Company or its licensors. These Terms do not transfer any intellectual property rights to you. All rights not expressly granted are reserved.
4. Your Data
4.1 Information You Provide
When you use the Services, you may provide or we may collect the following categories of information:
- (a) Account Information: Name, email address, and any optional profile details you provide at registration or in your settings.
- (b) Assessment Data: Your responses to assessment questions, response timing data, and associated validity indicators. This data is collected during the workstyle assessment and is used to compute your workstyle profile.
- (c) Comparison Data: When you participate in a peer comparison or apply to a job, your assessment data is compared against another individual's data to generate compatibility outputs.
- (d) Application Data: If you apply to a job through the Services, information you submit as part of the application — including your name, email, optional biography, resume, and links.
- (e) Usage Data: Information generated by your interaction with the Services, including pages viewed, features used, device and browser information, IP address, and access timestamps.
4.2 How We Use Your Data
We use the information described in Section 4.1 to:
- (a) Provide, operate, and improve the Services — including generating your workstyle profile, computing compatibility scores, and delivering comparison reports;
- (b) Process your assessment responses through automated scoring and narrative generation systems;
- (c) Communicate with you about the Services, including account notifications and Beta updates;
- (d) Monitor and enforce compliance with these Terms; and
- (e) Protect the security and integrity of the Services.
4.3 Automated Processing
Your assessment responses are processed by automated systems to generate workstyle profiles, compatibility scores, and narrative descriptions. No human reviews your individual responses or hand-writes your profile content. By completing an assessment, you consent to this automated processing.
You are not subject to decisions with legal or similarly significant effects based solely on automated processing. Compatibility scores are informational — any hiring, employment, or team-formation decisions remain with the humans using the Services.
4.4 Research and Improvement
We may use anonymized, aggregated, or de-identified data derived from assessment responses and usage patterns to:
- (a) Improve the accuracy and reliability of our assessment instruments and scoring algorithms;
- (b) Conduct internal research on workstyle compatibility and workplace dynamics;
- (c) Generate aggregate statistical reports (for example, benchmarks or trend analyses) that do not identify any individual; and
- (d) Publish or present findings based on aggregated data in academic, industry, or marketing contexts.
We will not re-identify de-identified data or sell your personally identifiable assessment data to third parties.
4.5 Sharing Your Data
We do not sell your personal information. We may share your information in the following circumstances:
- (a) Comparison Partners: When you participate in a peer comparison, your workstyle profile data is shared with the other participant to generate the comparison report. Both parties see the results.
- (b) Hiring Context: If you apply to a job through the Services, the hiring organization and its authorized users will see your application data, workstyle profile, and compatibility scores relevant to that role.
- (c) Service Providers: We use third-party services to host, operate, and support the Services (for example, cloud hosting, email delivery, and analytics). These providers access your data only as necessary to perform services on our behalf and are contractually obligated to protect it.
- (d) Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
- (e) Business Transfers: In connection with a merger, acquisition, or sale of assets, your data may be transferred as part of the transaction. We will notify you of any such transfer.
4.6 Data Retention
We retain your data for as long as your Account is active or as needed to provide the Services. If you delete your Account, we will delete or de-identify your personal data within 30 days, except where retention is required by law or necessary for legitimate business purposes (such as resolving disputes or enforcing these Terms). Anonymized and aggregated data described in Section 4.4 may be retained indefinitely.
4.7 Beta Data
Upon transition from Beta to general availability, we reserve the right to reset or delete all Beta data, including assessment responses, workstyle profiles, compatibility scores, and comparison reports. If we exercise this right, we will make reasonable efforts to notify you in advance so you may export or save any information you wish to retain. After a data reset, you may need to retake the assessment to continue using the Services.
4.8 Your Rights
You may request access to, correction of, or deletion of your personal data by contacting us at privacy@mauralink.com. We will respond to such requests within 30 days. Certain data may be retained as described in Section 4.6.
4.9 Security
We implement commercially reasonable technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
4.10 Children
The Services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected data from a child under 18, we will delete it promptly.
5. User Content and Conduct
5.1 User Content
“User Content” means any information or content you submit to the Services beyond assessment responses — including profile text, biographies, resumes, links, and any communications through the Services. You are solely responsible for your User Content.
5.2 License to User Content
You grant Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of providing and improving the Services. This license continues until you delete the relevant content or your Account, after which we will cease displaying it, though cached or archived copies may persist for a reasonable period.
5.3 Acceptable Use
You agree not to use the Services to:
- (a) Submit content that is unlawful, defamatory, harassing, abusive, threatening, obscene, or that violates any third party's rights;
- (b) Upload viruses, malware, or any software intended to damage or disrupt the Services;
- (c) Send unsolicited communications, spam, or chain messages;
- (d) Harvest or collect information about other users without their consent;
- (e) Interfere with or disrupt the Services, servers, or networks;
- (f) Attempt to gain unauthorized access to any part of the Services;
- (g) Impersonate another person or entity;
- (h) Use the Services in any manner that violates applicable law or regulation; or
- (i) Manipulate or attempt to manipulate assessment results — including by providing intentionally inaccurate responses, using automated tools to complete assessments, or completing assessments on behalf of another person.
5.4 Enforcement
We may (but are not obligated to) review User Content and take action if you violate these Terms, including removing content, suspending or terminating your Account, and reporting conduct to law enforcement if appropriate.
6. Third-Party Services
The Services may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy practices, or availability of third-party services. Your interactions with third-party services are governed by their own terms and policies.
7. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Without limiting the foregoing, we do not warrant that:
- (a) The Services will be uninterrupted, timely, secure, or error-free;
- (b) Workstyle profiles, compatibility scores, or any other outputs will be accurate, complete, or reliable;
- (c) The Services will meet your requirements or expectations; or
- (d) Any assessment results will predict actual job performance, employee retention, or workplace outcomes.
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, Company and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, cost of substitute services, or business interruption — arising from or related to your use of or inability to use the Services, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability to you for all claims arising from or related to these Terms or the Services shall not exceed fifty U.S. dollars ($50.00).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- (a) Your use of the Services;
- (b) Your violation of these Terms;
- (c) Your violation of applicable laws or regulations;
- (d) Your User Content; or
- (e) Any hiring, employment, or personnel decision you make using information obtained through the Services.
10. Term and Termination
10.1 Term
These Terms remain in effect while you use the Services or maintain an Account.
10.2 Termination by You
You may terminate your Account at any time by using the account deletion feature on the Site or by contacting us at support@mauralink.com.
10.3 Termination by Us
We may suspend or terminate your Account and access to the Services at any time, for any reason, at our sole discretion — including for violation of these Terms or discontinuation of the Beta program.
10.4 Effect of Termination
Upon termination, your right to access the Services ceases immediately. Termination may result in the deletion of your Account data, including assessment responses and workstyle profiles. We are not liable for any loss resulting from termination. Sections 1.3, 3.5, 4.4, 4.6, 5.2, 7, 8, 9, 11, and 12 survive termination.
11. Copyright
We respect the intellectual property rights of others. If you believe that content on the Services infringes your copyright, please send a written notice to legal@mauralink.com containing:
- (a) Your physical or electronic signature;
- (b) Identification of the copyrighted work you claim is infringed;
- (c) Identification of the allegedly infringing material and its location on the Services;
- (d) Your contact information (address, telephone number, email);
- (e) A statement that you have a good faith belief the use is not authorized by the copyright owner or the law; and
- (f) A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We will respond to valid notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and may remove or disable access to allegedly infringing material.
12. General
12.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
12.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the State of Delaware. You and Company each consent to the personal jurisdiction of such courts and waive any objection to venue therein.
Before initiating any legal proceeding, you agree to contact us at legal@mauralink.com and attempt to resolve the dispute informally for at least 30 days.
12.3 Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Site at least 15 days before the changes take effect. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of those changes.
12.4 Electronic Communications
You consent to receive communications from us electronically, including by email and notices posted on the Site. You agree that electronic communications satisfy any legal requirement for written communication.
12.5 Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
12.6 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
12.7 Assignment
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may freely assign these Terms. Any unauthorized assignment is void.
12.8 Entire Agreement
These Terms constitute the entire agreement between you and Company regarding the Services and supersede all prior agreements and understandings.
12.9 Export
You agree not to export or re-export any technical data or products obtained through the Services in violation of U.S. export laws or regulations.
